UN Fears War Crimes in Sri Lankan Civil War

In what some say is the final chapter of a civil war which has raged since 1983, the Sri Lankan government forces have encircled the LTTE (Liberation Tigers of Tamil Eelam), commonly known as the Tamil Tigers, in 40 km of coastline in the north east of the small island nation, after weeks of brutal fighting. Meanwhile the UN Human Rights Commissioner, Navi Pillay, has stated that both sides may be responsible for war crimes.
Ms. Pillay said that the Sri Lankan military had repeatedly shelled designated ’safe zones’ where civilians had sought shelter, and that the Tamil Tigers were responsible for capturing civilians and using them as human shields as well as shooting civilians fleeing from the fire fights. Ms. Pillay stated that, “the brutal and inhuman treatment of civilians by the LTTE is utterly reprehensible and should be examined to see if it constitutes war crimes,” and, “certain actions being undertaken by the Sri Lankan military and by the LTTE may constitute violations of international human rights and humanitarian law.” The UN has stated that not only should the government not be murdering its own civilians through shelling it needs to be actively pursuing means to help evacuate and support internally displaced persons.
The Sri Lankan government has rebutted the statement, arguing that they have repeatedly stated that they have never fired on the “no fire zones” and that it was incredibly unprofessional for the United Nations to be making such statements. There has been no immediate redress from the Tamil Tigers on the matter, but both the Tigers and the Sri Lankan government have accused each other of attacks on civilians. International human rights groups such as Amnesty International and Human Rights Watch have both reported human rights abuses by the Tigers and the Sri Lankan Army.
American Response
Of course since Secretary of State Hillary Clinton needs to assert her clout in all regions of the world, she had much to say in her meeting with the President of Sri Lanka. Mrs. Clinton expressed the US’s concern for the civilian population which has been displaced and caught between lines since the beginning of the conflict. However, she also congratulated the Sri Lankan government on destroying terrorism in its state. Disregarding the fact that the Tamil movement is based around an ethnic population which has existed on the island for over 2, 500 years, and that America has been the primary champion of self determination since it became a doctrine of international relations after the founding of the League of Nations. Clinton also stated that she was glad that Sri Lanka was finally ending this conlfict and America looked forward towards building a new peace for the island nation.

Hello John Lochlan,
I’m Mike and I have been following Politonomist for the last couple of weeks. I enjoy reading your detail reports.
WRT this article, my parents are originally from Sri Lanka and we have been greatly effected by the current humanitarian situation there. Not sure if you are also following the situation closely but the Sri Lankan government has expelled all UN, ICRC, and other international organizations from areas controlled by the LTTE. The Sri Lankan government has also rejected calls for a ceasefire from Canada, EU, and other western nations. The government has been engaged in indiscriminate shellings and bombardments including the use of cluster bombs on civilans. Over last few weeks at least 60-80 civilians have been killed daily!!
I would also like to leave you with few links on how the Sri Lankan government has been using the world Terrorism to eradicate a whole race in that island.

Thanks for a fair analysis. Its confusing what criteria UN and human rights bodies follows when it comes to action or in other words reacts to a humanitarian catastrophe.
Even though, UN learned valuable lessons in Rwanda and Congo, still fail to act meaningful in Darfur. In Darfur 300 000 were Genocide, ICC sentenced President Omar al-Bashir for Crime against Humanity. The angry Bashir ordered UN humanitarian missions out of the country. Again civilians are victimized in a justice process. UN is yet to react on this issue.
In Gaza, UN act promptly and worked hard for a ceasefire.
In the case of Tamils in Sri Lanka, UN is reluctant to accept casualty figures, or to call a ceasefire. The plight of the affected people always falls behind in UN’s agenda.
Does this mean to conclude UN is politicized?

The Sri Lankan government is perpetrating massive human rights violations. Witnesses have testified the slaughter of Tamil civilians including indiscriminate bombings and torture of innocent civilians even in the so called safe zones. There have been more than 3,750 extrajudicial killings, over 30,000 Tamils suffering serious bodily injury, over 1.3 million displacements, and in January and February alone around 3000 Tamil civilians were killed of which 1000 were children.
The Sri Lankan government has shown a total disregard for the Geneva Convention in the treatment of Tamils in government cleared areas and refugee camps. They have refused access to the camps by most humanitarian organizations and they have not granted free access to the ICRC.
I believe, the UN has lost its credibility long ago, I do not know why this world behaves like blind.

Dear John,
Thank you for the coverage of an issue that is at the heart of several hundred thousand Tamil expatriates. I personally know several families that have had their relatives murdered by the Sri Lankan government bombing and shelling of so-called “safe zones”. What our nations are demanding the Tamils to do is pathetic, i.e to go into the hands of the Sri Lankan government that is already killing them, so that they can be killed/tortured or put in concentration camps, is nothing short of Nazi mentality.
All of this may have been acceptable during a Bush era, but I thought we had a new President down south, who has promised hope and justice for all people, especially the minorities. I sincerely hope that this article makes it to Senator Clinton and paves the way for a fair referendum for self determination for Tamils. That is how things are done in a democracy, isnt it?

- 75% of the Tamil population displaced
- more than one million Tamil refugees around the world
- Not even a single Sinhalese refugee anywhere around the world
- Sri Lankan Government not ready to accept referendum or federal model or UN mandated solution or any other political solution.
But, UN still fears of War Crimes. What else UN wants to confirm the genocide against Tamils?
UN has become a New Agency. UN should impose sanctions on Sri Lanka before it’s too late.
Don’t make the Tamils also commemorates “Holocaust Remembrance Day”.
